The works of art (“Works”) offered by or through the Colours of our Country website (“Site”) are made available subject to the following terms and conditions (“Terms and Conditions”). By accessing and using the Website, you agree to be bound by, and to comply with, the Terms and Conditions and any further terms and conditions that Wrapped Creations Pty Ltd (ABN 81 600 953 768) may prescribe from time to time.
1. CONTENT DISPLAYED ON THE SITE
1.1 You agree that the images of the Works displayed on the Site (“Site Images”) are guidelines only.
1.2 Wrapped Creations Pty Ltd has taken reasonable care to ensure that the Works are presented as accurately as possible and will accept no responsibility for differences between the Site Images and the actual Works.
1.3 The Site and its content, including but not limited to the Site Images, may not be copied, modified, reproduced, republished, posted, transmitted, transferred or sold, displayed, or in any way exploited, in whole or in part, except as is expressly permitted by Wrapped Creations Pty Ltd.
2. LIMITATION OF LIABILITY
2.1 Specifications about and other information and material regarding any Works for sale on the Site are provided by the Artist(s) or Art Centre(s). Whilst Wrapped Creations Pty Ltd makes every effort to ensure that the information and material on the Site is accurate, Wrapped Creations Pty Ltd makes no representations or warranties as to the accuracy or reliability of any information provided on the Site. You acknowledge that any reliance on representations and warranties provided by any Artist or Art Centre shall be at your own risk.
3. INTELLECTUAL PROPERTY RIGHTS
3.1 All Works are owned solely by the relevant Artist(s) or Art Centre(s) and are subject to Australian and international copyright laws. The Artist(s) or Art Centre(s) warrants that they the title to and owns the Works represented to be owned by him on the Site.
3.2 The sale of the copyright in a Work is a separate transaction and not part of the sale of the Work unless otherwise agreed in writing between yourself and the Artist(s) or Art Centre(s).
4. PRODUCT AVAILABILITY
4.1 Wrapped Creations Pty Ltd shall not be liable, directly or indirectly, for any loss or damages of whatsoever nature suffered by you due to the unavailability of any Works featured on the Site for any reason whatsoever.
5. ONLINE PAYMENT – STRIPE
5.1 All online credit card payments are processed by Stripe.
5.2 Card Holders may go to https://stripe.com/docs/security/stripe to view Stripe’s security policy.
6. SHIPPING – BOORLOO (PERTH) EXHIBITION
6.1 Standard shipping is calculated on a per product basis for Australian customers only.
6.2 Delivery will be via the approved freight provider, Pack and Send.
6.3 International shipping is not available
6.4 The collection of artwork will only be available on Friday 2 October 2026 between 4-6pm at Central Park foyer, 152-158 St Georges Terrace, Boorloo (Perth). All orders after this day will be available by shipping only.
7. DISPATCH AND DELIVERY
7.1 Colours of our Country offers one set dispatch date for the shipping of all sold items. The dispatch date is Friday 9 October 2025. No special delivery dates or requests will be entered into.
7.2 Delays may occur in the delivery of the purchased artwork which is outside of the contract of Wrapped Creations Pty Ltd
7.3 We are unable deliver to PO Boxes as our couriers require a street address for delivery.
7.4 If a re-delivery is requested, charges will apply. Please contact us for information on re-delivery fees.
8. RIGHT TO CANCEL
8.1 Once an order is placed and paid for it is considered final and no amendments or cancellations can be made.
9. RETURNS POLICY
9.1 All artwork dispatched via Pack and Send will be covered by their refund policy for damage only.
9.2 Any damage should be reported immediately upon receiving the delivery. Photographs of the damage must be supplied as proof, please email these to info@wrappedcreations.com.au. Please retain original packaging as we may need to arrange for collection of the damaged or faulty item.
9.3 In the case where a refund is issued, the refund will be facilitated through your original payment method.
9.4 We offer a 2-Day Money Back Guarantee for artworks purchased sight-unseen. The guarantee does not apply to commissioned artworks. If you purchase online, you must view the artwork in person within 48 hours of purchasing to be eligible for a refund. If you are not satisfied with your purchase, please discuss with the exhibition manager either in-person at the sales counter or via info@wrappedcreations.com.au. Refunds will not be applicable after this period.
9.5 Please note that a refund is only applicable during the exhibition period. Once the exhibition has closed, no further refunds or returns are available. Artworks purchased in-person during the exhibition are not eligible for return or refund, unless approved by the exhibition manager.
9.6 Please select your artwork carefully, as refunds or exchanges are not available for change of mind. Customers should inspect the artwork promptly upon collection or delivery. Any visible damage arising before collection or during delivery arranged by us should be reported within 48 hours of receiving the artwork, together with the order details and photographs of the damage. Reporting within this timeframe assists us in investigating the matter promptly, particularly as Colours of Our Country is a temporary exhibition. Where an artwork is damaged, defective or materially different from its description, we will assess the matter and provide an appropriate remedy in accordance with applicable consumer law. Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
AGREEMENT OF TERMS
By placing an order with Colours of our Country you are agreeing to the above terms and conditions. These terms are subject to change at any time. If the terms are amended, they will be effective immediately.
